WIN a 2017 Signed MFC Guernsey Terms & Conditions (“Conditions of Entry”)

  1. Promotion: WIN a 2017 Signed MFC Guernsey (the “Promotion”).
  2. Promoters:

  3. The Promotion commences on 31.05.2017 at 10:00 AM AEST and ends on 19.06.2017 at 11:59 PM AEST (“Promotional Period”). Entries must be received during the Promotional Period. Entries are deemed to be received at the time of receipt by the Promoters and not at the time of transmission or deposit by the entrant. Records of the Promoters and its agencies are final and conclusive as to the time of receipt.
  4. The entrant agrees and acknowledges that they have read these Conditions of Entry and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry.
  5. Entry is open to Australian residents excluding residents of New South Wales and Australian Capital Territory (Eligible Entrants) directors, management, employees (and their immediate families) of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate.
  6. To enter the Promotion during the Promotional Period, the entrant must complete all of the following steps to receive one (1) entry into the next upcoming draw displayed on the promotional website (based on the time and date of entry):
    1. visit the Melbourne Football Club promotional website http://ig-mfc.com/win-signed-guernsey-2017-competition/ and
    2. complete the entry form for the promotion by submitting the requested details, including a valid email address, first name, last name and contact phone number.
  7. There is one (1) prize to be won in this Promotion with a total value of $400.00.
  8. Description of Prizes: 2017 MFC Home guernsey signed by players on the 2017 MFC men’s list.
  9. The winners of the prizes will be determined by draw. There will be one (1) draw only. The draw will take place at Melbourne Cricket Ground, 120 Jolimont St, Melbourne, VIC 3000 on 03.07.2017 at 11:00 AM AEST.
  10. The winner of the prize draw will be the first eligible entry drawn at that draw (“winning entry/entrant”).
  11. The draw will be conducted by computerised draw system or selection. The Promoter warrants that the computerised draw system used to draw the prize has been appraised by a suitably qualified person into the operation and integrity of the computerised draw system. The winning entrant does not need to be present at the draw to claim the prize. If any particular draw is scheduled on a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoters will ensure the draw is open for public scrutiny and anyone may witness the draw on request. Winners of the drawn prize are determined by chance. Skill plays no part in determining the winner.
  12. The prize is not transferable, substitutable or exchangeable for another prize of equal or like value and is not redeemable for cash (including any unused portion). If a winner chooses not to take their prize (or is unable to), they forfeit the prize and the Promoters are not obliged to substitute the prize.
  13. The value of the prize(s) is accurate and based upon the recommended retail value of the prize(s) (inclusive of GST) at the date of printing. The Promoters accept no responsibility for any variation in the value of the prize(s) after that date.
  14. The entrant may enter the Promotion once during the Promotional Period and only one eligible entry per day will be accepted. The entrant is eligible to win 1 prize.
  15. The winning entrant will be notified on the day of the relevant draw via telephone call to the phone number provided by the winner. A representative of the Promoter will call the phone number provided by the winner, and if necessary, leave a voicemail message including a contact phone number. The winner must be available to be contacted via that phone number or contact the Promoter within twenty four (24) hours of the draw (by 1:00 PM AEST on the day of the draw).
  16. If required and subject to any direction under relevant state legislation, if the winner cannot be contacted, is unavailable to collect or accept any prize, or is not already in attendance at the respective Event, they may be deemed ineligible to win and forfeit any entitlement to the prize (as determined by the Promoters in their sole and absolute discretion) and the Promoters may then elect to award the prize to a reserve winner. All reasonable attempts will be made to contact each winner.
  17. No entry fee is charged by the Promoters to enter the Promotion.
  18. The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid.
  19. If the entrant has consented (“opted-in”) in accordance with the Australian Privacy Principles, their personal information will be disclosed to the Promoters. Personal information will be stored on the Promoters’ databases and the Promoters may use this information for future marketing purposes regarding their products, including contacting the entrant electronically.
  20. The Promoters are bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy is located at http://www.ig.com/au/privacy-policy and http://www.melbournefc.com.au/privacy. The Promoters collect personal information about entrants to enable them to participate in this Promotion and may disclose the entrant’s personal information to their contractors and agents to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
  21. For the purposes of public statements and advertisements, the Promoters will only publish the winner’s surname, initial and State. Entrants can request access to the personal information the Promoters hold about them by contacting the Promoters and any request to access, update or correct any information should be directed to the Promoters. The Promoters will not send, allow to be sent, or assist in the sending of one or more unsolicited commercial electronic messages with an Australian link for purposes of the Spam Act 2003, use or distribute any software designed to harvest email addresses or otherwise breach the Spam Act 2003 or the Spam Regulations 2004 (Cth).
  22. The Promoters reserve the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoters determine in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release as determined by the Promoters in their absolute discretion, prior to receiving the prize(s).
  23. If the prize(s) is provided to the Promoters by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoters. The terms and conditions which apply to the prize(s) at the time they are issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency.  The Promoters accept no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  24. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  25. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoters, the Promoters may in their sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, subject to State or Territory regulation.
  26. The Promoters reserve the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  27. The Promoters reserve the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoters is final and binding on each entrant and no correspondence will be entered into.
  28. The Promoters and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  29. The entrant warrants and represents that any material sent or provided by the entrant to the Promoters will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that the entrant has all rights to use the materials and has obtained all necessary consents to comply with any relevant privacy and/or confidentiality requirements.
  30. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoters may use any such marketing and editorial material without further reference or compensation to them.
  31. Unless otherwise specified, the prize(s) is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
  32. The Promoters accept no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  33. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of these rights.

IG Share Trading Promotion Terms & Conditions

  1. These terms and conditions (the “Rules”) apply to the IG Melbourne Football Club (“MFC”) Share Trading Account Promotion (the “Promotion”). By participating in the Promotion, participants agree to be bound by these Rules. All capitalised but undefined terms herein shall be deemed to have the same meaning as given to such terms in your Share Trading Customer Agreement.
  2. The Promotion is organised by IG Markets Limited (“we”, “our”, or “us”) with their registered address being Level 15, 55 Collins Street, Melbourne, Victoria, 3000, Australia (“IG”).

Eligibility

  1. To be eligible to take part in the Promotion (a “Qualifying Participant”)  you must fulfil the following criteria:
    1. you must successfully open a Share Trading account with us (in accordance with our usual account opening rules);
    2. you must be a 2016 or 2017 member of the Melbourne Football Club;
    3. you must be a new IG Share Trading client; and
    4. you will not be eligible to participate in the Promotion if you are an employee (or any relation or partner or agent of an employee) of IG.

Promotion details

  1. The first 20 MFC members to successfully open an IG Share Trading account with us (subject to our usual account opening rules) and successfully transfer shares to that account will win a 2016 football or a jersey signed by the MFC team (the “Prizes”). You must complete a stock transfer form and send it to us at: Attention: IG Stock Transfers, Level 15, 55 Collins Street, Melbourne, Victoria, 3000, Australia together with your MFC membership number and postal address by 31 October 2016. IG reserves the right in its sole discretion to determine the first 20 successful Qualifying Participants (the “Winners”).
  2. The Prizes are non-redeemable, non-transferable, non-assignable and non-exchangeable. Each Winner will receive one Prize. IG makes no warranty or representation to the quality, value or fitness for purpose of the Prizes and assumes no liability or responsibility for defects in the Prizes. IG reserves the right to substitute alternative prizes which may not be of equivalent value at any time by notifying the Winners.
  3. IG will send the Prizes to the postal address specified in the Winners’ letter containing their stock transfer forms and MFC numbers. IG assumes no liability for incorrect, illegible or incomplete address details. No payment or compensation of any kind shall be made for any uncollected, lost, misplaced, defaced, stolen or damaged Prize.
  4. If any provision of these Rules conflicts with any provision of your Share Trading Customer Agreement, the Share Trading Customer Agreement shall prevail.
  5. Wholesale clients are expressly excluded from participating in this Promotion.

General

  1. We are the sole arbiter of the Promotion, these Rules and any other issues arising under this Promotion. Exceptions to these Rules are at the sole discretion of IG’s management, and our decision is final. We reserve the right to alter, amend or terminate the Promotion or any aspect of it at any time and without prior notice.
  2. We will not be held liable for any losses incurred by you as a result of your trading in relation to this Promotion. Trading CFDs is a high risk activity and it is possible to lose more than your initial investment.
  3. Any dispute or situation not covered by the terms of this Promotion will be resolved by our management in a manner it deems to be fairest to all concerned and that decision shall be final and binding on all parties. We reserve the right to refuse the award a Prize under the Promotion if we have reasonable belief that the Promotion is being abused in any way.
  4. If at any time all or any part of any provision of these Rules are or become illegal, invalid or unenforceable in any respect under the law of any jurisdiction, such provision(s) shall not affect or impair the legality, validity or enforceability in that jurisdiction of the remainder of that provision or all other provisions of these Rules or the legality, validity or enforceability under the law of any other jurisdiction of that provision or all other provisions of these Rules.
  5. These Rules shall be governed by and construed in accordance with the laws of Victoria, Australia and shall by subject to the jurisdiction of the Victorian courts.

 

IG Trade Up Terms & Conditions (“Conditions of Entry”)

  1. Promotion: IG Trade Up (the “Promotion”).
  2. Promoters:
    1. IG Australia Pty Ltd, ACN 096 585 410 at Level 15, 55 Collins St, Melbourne, VIC 3000, 1800 601 734; and
    2. Melbourne Football Club Limited, ACN 005 686 902 at Melbourne Cricket Ground, Great Southern Stand, PO Box 254, East Melbourne, VIC 8002.
  3. The Promotion commences on 10.02.2016 at 6:00 PM AEST and ends on 03.08.2016 at 10:00 AM AEST (“Promotional Period”). Entries must be received during the Promotional Period. Entries are deemed to be received at the time of receipt by the Promoters and not at the time of transmission or deposit by the entrant. Records of the Promoters and its agencies are final and conclusive as to the time of receipt.
  4. The entrant agrees and acknowledges that they have read these Conditions of Entry and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry.
  5. Entry is open to Australian residents aged 18 and over who are entitled to attend the Melbourne Cricket Ground for one of the following 2016 Toyota Premiership Season Melbourne Football Club home games (each an “Event”):
    1. Game 1: Round 1 Melbourne v GWS Giants on 26.03.2016 at 1:40 PM AEST;
    2. Game 2: Round 5 Melbourne v Richmond on 24.04.2016 at 7:10 PM AEST;
    3. Game 3: Round 8 Melbourne v Western Bulldogs on 15.05.2016 at 3:20 PM AEST;
    4. Game 4: Round 9 Melbourne v Brisbane Lions on 22.05.2016 at 1:10 PM AEST;
    5. Game 5: Round 12 Melbourne v Collingwood on 13.06.2016 at 3:20 PM AEST;
    6. Game 6: Round 15 Melbourne v Adelaide Crows on 3.07.2016 at 3:20 PM AEST;
    7. Game 7: Round 19 Melbourne v Gold Coast Suns on 31.07.2016 at 1:10 PM AEST; and
    8. Game 8: Round 20 Melbourne v Hawthorn on 6.08.2017 at 2:10 PM AEST;

    Employees of the Promoters and the employee’s immediate families, its retailers, distributors, suppliers and associated companies and agencies are not eligible to enter. Entrants must reside in Australia. Valid and eligible entries will be accepted up to 03.08.2016 by 10:00 AM AEST.

  6. To enter the Promotion during the Promotional Period, the entrant must complete all of the following steps to receive one (1) entry into the selected event displayed on the promotional website:
    1. visit the Melbourne Football Club promotional website at http://ig-mfc.com/trade-up; and
    2. complete the entry form for the promotion by submitting the requested details, including a valid email address, first name, last name and contact phone number.
  7. There are eight (8) prizes to be won in this Promotion with a total value of $3184.
  8. Description of Prizes:
    1. There are eight (8) prizes available to be won, one (1) relating to each of the Events. Each individual prize consists of a Ticket Upgrade and Hospitality Package valued at $398 each. The winner will be entitled to select up to three (3) people also in attendance at the same Event. The winner and the selected persons will have their seats upgraded and receive a hospitality package for the duration of the Event (unless already seated at the highest grade possible).
    2. To be eligible to win a prize, the entrant must have a separate right of entry to the MCG to attend the Event to which that prize relates. To avoid confusion, the prizes do not include entry to the Event or to the MCG.
  9. The winners of the prizes will be determined by draw. There will be eight (8) draws, one (1) for each prize. The draws will take place at Melbourne Cricket Ground, 120 Jolimont St, Melbourne, VIC 3000 on the following dates at 11:00 AM AEST:
    1. Game 1 draw: 23.03.2016
    2. Game 2 draw: 20.04.2016
    3. Game 3 draw: 11.05.2016
    4. Game 4 draw: 18.05.2016
    5. Game 5 draw: 11.06.2016
    6. Game 6 draw: 29.06.2016
    7. Game 7 draw: 27.07.2016
    8. Game 8 draw: 3.08.2016
  10. The winner of the prize for each draw will be the first eligible entry drawn at that draw (“winning entry”).
  11. Each draw will be conducted by computerised draw system or selection. The Promoter warrants that the computerised draw system used to draw the prize has been appraised by a suitably qualified person into the operation and integrity of the computerised draw system. The winning entrant does not need to be present at the draw to claim a prize. If any particular draw is scheduled on a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoters will ensure each draw is open for public scrutiny and anyone may witness the draw on request. Winners of the drawn prize are determined by chance. Skill plays no part in determining the winner.
  12. The prize is not transferable, substitutable or exchangeable for another prize of equal or like value and is not redeemable for cash (including any unused portion). If a winner chooses not to take their prize (or is unable to), they forfeit the prize and the Promoters are not obliged to substitute the prize.
  13. Tickets or rights for prizes involving alcohol will not be distributed by or to any person under 18, nor can a person under 18 dispense or collect a prize involving alcohol. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws or codes including those relating to the responsible service of alcohol. The Promoters support the responsible service of alcohol.
  14. The value of the prize(s) is accurate and based upon the recommended retail value of the prize(s) (inclusive of GST) at the date of printing. The Promoters accept no responsibility for any variation in the value of the prize(s) after that date.
  15. The entrant may enter the Promotion once a day during the Promotional Period and only one eligible entry per day will be accepted. The entrant is eligible to win 1 prize.
  16. Each winner will be notified on the day of the relevant draw via telephone call to the phone number provided by the winner. A representative of the Promoter will call the phone number provided by the winner, and if necessary, leave a voicemail message including a contact phone number. The winner must be available to be contacted via that phone number or contact the Promoter within two (2) hours of the draw (by 1:00 PM AEST on the day of the draw).
  17. There will be 5 additional entries drawn after the winning entry at each of the draws for Game 1, 2, 3 and 4 respectively, to be held as reserve winners for the prize. Reserve winners for a draw will be recorded in the order drawn and used only in the instance that the relevant winning entry for the draw is deemed ineligible, or the prize winner cannot be contacted, is unavailable to collect or accept the prize, or does not already have a right of attendance at the respective Event. A reserve winner will not be entitled to receive the prize, except pursuant to this clause and clause 16.
  18. If required and subject to any direction under relevant state legislation, if the winner cannot be contacted, is unavailable to collect or accept any prize, or is not already in attendance at the respective Event, they may be deemed ineligible to win and forfeit any entitlement to the prize (as determined by the Promoters in their sole and absolute discretion) and the Promoters may then elect to award the prize to a reserve winner as outlined in clause 16. All reasonable attempts will be made to contact each winner.
  19. No entry fee is charged by the Promoters to enter the Promotion.
  20. Prizes will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid.
  21. If the entrant has consented (“opted-in”) in accordance with the Australian Privacy Principles, their personal information will be disclosed to the Promoters. Personal information will be stored on the Promoters’ databases and the Promoters may use this information for future marketing purposes regarding their products, including contacting the entrant electronically.
  22. The Promoters are bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy is located at http://www.ig.com/au/privacy-policy and http://www.melbournefc.com.au/privacy. The Promoters collect personal information about entrants to enable them to participate in this Promotion and may disclose the entrant’s personal information to their contractors and agents to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
  23. For the purposes of public statements and advertisements, the Promoters will only publish the winner’s surname, initial and State. Entrants can request access to the personal information the Promoters hold about them by contacting the Promoters and any request to access, update or correct any information should be directed to the Promoters. The Promoters will not send, allow to be sent, or assist in the sending of one or more unsolicited commercial electronic messages with an Australian link for purposes of the Spam Act 2003, use or distribute any software designed to harvest email addresses or otherwise breach the Spam Act 2003 or the Spam Regulations 2004 (Cth).
  24. The Promoters reserve the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoters determine in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release as determined by the Promoters in their absolute discretion, prior to receiving the prize(s).
  25. If the prize(s) is provided to the Promoters by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoters. The terms and conditions which apply to the prize(s) at the time they are issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoters accept no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  26. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  27. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoters, the Promoters may in their sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, subject to State or Territory regulation.
  28. The Promoters reserve the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  29. The Promoters reserve the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoters is final and binding on each entrant and no correspondence will be entered into.
  30. The Promoters and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  31. The entrant warrants and represents that any material sent or provided by the entrant to the Promoters will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that the entrant has all rights to use the materials and has obtained all necessary consents to comply with any relevant privacy and/or confidentiality requirements.
  32. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoters may use any such marketing and editorial material without further reference or compensation to them.
  33. Unless otherwise specified, the prize(s) is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
  34. The Promoters accept no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  35. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of these rights.
